Complaint Procedure
At Fawkes Digital Marketing, we respect the intellectual property rights of others and expect our users and partners to do the same. If you believe that content hosted, displayed, or distributed through our services infringes your copyright or other intellectual property rights, please send a written notice to our Designated Agent including the following details:
- Authorized Signature: An electronic or physical signature of the person authorized to act on behalf of the owner of the intellectual property that is allegedly infringed.
- Description of the Work: A clear description of the copyrighted work or other intellectual property that you claim has been infringed.
- Identification of the Material: Details of the material that you believe is infringing, including its location within our services or the specific URL where it appears.
- Contact Information: Your full name, address, telephone number, and email address so that we can contact you regarding your complaint.
- Good Faith Statement: A statement confirming that you have a good-faith belief that the disputed use of the material is not authorized by the copyright or intellectual property owner, its agent, or the law.
- Accuracy and Authority Statement: A statement made under penalty of perjury that the information in your notice is accurate and that you are authorized to act on behalf of the owner of the intellectual property that is allegedly infringed.
Please note: Submitting false claims of infringement may result in legal liability under Section 512(f) of the U.S. Copyright Act.
Counter-Notice Procedure
If you are a user or client of Fawkes Digital Marketing and believe that your material has been wrongly removed or disabled in response to an IPR complaint, you may file a counter-notice by sending the following information to our Designated Agent:
- Your Signature: A physical or electronic signature.
- Identification of Removed Material: The material that has been removed or to which access has been disabled, and the location where the material appeared before removal or disabling.
- Good Faith Statement: A statement under penalty of perjury that you believe in good faith that the material was removed or disabled due to mistake or misidentification.
- Contact and Consent: Your name, address, email address, and telephone number, and a statement consenting to the jurisdiction of the appropriate Federal District Court for your address (or for the location of Fawkes Digital Marketing if outside the U.S.), and that you will accept service of process from the complainant or their agent.
Please note: Knowingly misrepresenting that material was removed by mistake or misidentification may result in legal liability under Section 512(f) of the U.S. Copyright Act. Repeated infringement may also result in account suspension or termination.
